Privacy Policy

This Privacy Policy for Personal Data (hereinafter referred to as the "Privacy Policy") applies to all information that the website "Any2text" located at the domain name https://any2text.com/ may collect about the User during the use of the website.

1. Definition of Terms

1.1. The following terms are used in this Privacy Policy:

1.1.1. "Website Administration (hereinafter referred to as the Administration)"

Authorized employees managing the website, acting on behalf of TOO TopTama, who organize and/or carry out the processing of personal data, as well as determine the purposes of processing personal data, the composition of personal data subject to processing, and the actions (operations) performed with personal data.

1.1.2. "Personal Data"

Any information relating directly or indirectly to an identified or identifiable natural person (personal data subject).

1.1.3. "Processing of Personal Data"

Any action (operation) or set of actions (operations) carried out using automation tools or without using such tools with personal data, including:

  • systematization,

  • clarification (updating, modification),
  • extraction,
  • use,
  • transfer (distribution, provision, access),
  • depersonalization,
  • blocking,

1.1.4. "Confidentiality of Personal Data"

A requirement obligatory for compliance by the Operator or any other person who has gained access to personal data, not to allow their dissemination without the consent of the personal data subject or the presence of another legal basis.

1.1.5. "Website User (hereinafter - User)"

A person who has access to the Website through the Internet and uses the Website service.

1.1.6. "Cookies"

A small piece of data sent by a web server and stored on a user's computer, which a web client or web browser sends to the web server with each HTTP request when trying to open a page of the corresponding website.

1.1.7. "IP address"

A unique network address of a node in a computer network built on the IP protocol.

1.1.8. "Legislation"

The current legislation of the Republic of Kazakhstan.

1.1.9. "Service(s)"

Services provided by the Operator based on an agreement.

2. General Provisions

3. Subject of the Privacy Policy

3.1. This Privacy Policy establishes the obligations of the website Administration regarding non-disclosure and ensuring the confidentiality of personal data that the User provides at the request of the website Administration when registering on the service website or when filling out a feedback form.

3.2. Personal data permitted for processing under this Privacy Policy is provided by the User by filling out the registration form on the "Any2text" website.

3.3. The "Any2text" website protects Data that is automatically transmitted during the viewing of advertising blocks and when visiting pages where the statistical script of the system ("pixel") is installed:

  • 5.2. The Administration has the right to transfer data to third parties in the following cases:
    • 5.2.1. The User has consented to such actions, including cases where the User applies settings of the used software that do not restrict the provision of certain information.
    • 5.2.2. The transfer is necessary within the use of the Website's functional capabilities by the User.
    • 5.2.3. The transfer is required for the purposes of data processing.
    • 5.2.4. In connection with the transfer of the website to the ownership, use, or property of such a third party.
    • 5.2.5. Upon request of a court or other authorized state body within the established legislative procedure.
    • 5.2.6. To protect the rights and legitimate interests of the Administration in connection with the violations committed by the User.
  • 5.3. In case of loss or disclosure of personal data, the website Administration informs the User about the loss or disclosure of personal data.
  • 5.4. The website Administration takes necessary organizational and technical measures to protect the User's personal information from unlawful or accidental access, destruction, alteration, blocking, copying, distribution, as well as from other unlawful actions of third parties.
  • 5.5. The website Administration, jointly with the User, takes all necessary measures to prevent losses or other negative consequences caused by the loss or disclosure of the User's personal data.
  • 5.6. The Operator has the right to transfer Personal Data and User Data without the User's consent to the following persons:
    • 5.6.1. State authorities, including investigative and law enforcement agencies, and local self-government bodies upon their reasoned request.
    • 5.6.2. In other cases directly provided for by the current legislation of the Republic of Kazakhstan.

6. Obligations of the Parties

6.1. The User is obliged to:

  • 6.1.1. Provide the information about personal data necessary for using the Website.
  • 6.1.2. Update and supplement the provided information about personal data in case of any changes to this information.

6.2. The website Administration is obliged to:

  • 6.2.1. Use the received information exclusively for the purposes specified in clause 4 of this Privacy Policy.
  • 6.2.2. Ensure the confidentiality of confidential information, not to disclose it without the prior written permission of the User, as well as not to sell, exchange, publish, or disclose in any other possible way the transmitted personal data of the User, except as provided in clause 5.2 of this Privacy Policy.
  • 6.2.3. Take precautions to protect the confidentiality of the User's personal data in accordance with the procedure commonly used to protect such information in the existing business practice.
  • 6.2.4. Block personal data related to the respective User from the moment of the User's request or inquiry, or from the moment of the request of their legal representative or authorized body for the protection of the rights of personal data subjects, for the period of verification in case of identification of inaccurate personal data or unlawful actions.

7. Responsibility of the Parties

  • 7.1. The website Administration, failing to fulfill its obligations, shall be liable for losses incurred by the User due to unlawful use of personal data, in accordance with the legislation of the Republic of Kazakhstan, except for cases provided in clauses 5.2 and 7.2 of this Privacy Policy.
  • 7.2. In case of loss or disclosure of Confidential Information, the website Administration shall not be liable if such confidential information:
    • 7.2.1. Became public domain before its loss or disclosure.
    • 7.2.2. Was obtained from a third party before its receipt by the website Administration.
    • 7.2.3. Was disclosed with the User's consent.

8. Dispute Resolution

  • 8.1. Prior to filing a lawsuit in court with a claim arising from the relationship between the User of the website and the website Administration, it is mandatory to submit a claim (a written proposal for voluntary settlement of the dispute).
  • 8.2. The recipient of the claim shall, within 30 calendar days from the date of receipt of the claim, notify the claimant in writing of the results of the claim consideration.
  • 8.3. If no agreement is reached, the dispute shall be submitted for consideration to a judicial authority in accordance with the current legislation of the Republic of Kazakhstan.
  • 8.4. This Privacy Policy and the relationship between the User and the website Administration are governed by the current legislation of the Republic of Kazakhstan.

9. Additional Terms

  • 9.1. The website Administration reserves the right to make changes to this Privacy Policy without the User's consent.
  • 9.2. The new Privacy Policy comes into effect from the moment it is posted on the Website, unless otherwise provided by the new version of the Privacy Policy.
